General Terms and Conditions (AGB)

1. Scope of Application

These General Terms and Conditions (AGB) govern all contracts concluded between VARIAD (hereinafter referred to as "Contractor") and its customers (hereinafter referred to as "Client"). Any conflicting or deviating terms and conditions of the Client shall not apply unless the Contractor has expressly agreed to them in writing.

2. Conclusion of Contract

The services presented on the website do not constitute a legally binding offer. A contract is only formed when the Client accepts an individual offer provided by the Contractor or when the Contractor confirms an order in writing.

3. Services

The Contractor provides professional services in the fields of Social Media Marketing, Content Creation, and Performance Advertising. The precise scope of services is defined in the respective individual offer or service agreement.

4. Remuneration & Payment

The agreed remuneration shall apply. All prices quoted are final prices. Pursuant to § 19 UStG (German VAT Act), no sales tax (VAT) is charged due to the small business regulation.

5. Liability

The Contractor shall be liable without limitation for damages caused by intent or gross negligence. In cases of slight negligence, liability is limited to the breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to foreseeable, typical damage.

6. Final Provisions

The law of the Federal Republic of Germany shall apply. The place of jurisdiction for all disputes arising from this contractual relationship is the Contractor's place of business, provided the Client is a merchant, a legal entity under public law, or a special fund under public law.
